NorthstarMLS does not mandate staging disclosure — its own page says it ‘is recommended’. What IS mandatory: furniture-only staging, and no text on a listing photo.

Not as a rule — NorthstarMLS recommends it. Its own Virtual Staging policy page says: “If furniture is added through virtual staging, it is recommended it be disclosed in agent remarks, public remarks or photo captions.” Recommended, and any of the three locations. The 2026 NorthstarMLS Rules — restructured effective July 1, 2026 — contain no virtual staging, watermark, AI or digitally-altered-image provision at all; §4.12 merely requires that a photo exist. What IS binding is the accuracy limit: staging may alter personal property (furniture) only, never the real estate, and “virtual painting is ok if there is full disclosure and you refrain from hiding any defects.” And one rule cuts directly against the industry habit of stamping photos: “No text (regardless of message) is allowed.” In Minnesota, the disclosure belongs in the caption or the remarks — putting it on the image is itself the violation. A separate set of AI guidelines published July 10, 2026 is labelled by NorthstarMLS as proposed, not adopted; treat it as best practice and re-check its status.

  • NO MANDATORY DISCLOSURE RULE EXISTS. NorthstarMLS’s official Virtual Staging resource page states the duty as a RECOMMENDATION, verbatim: “Virtual Staging is acceptable as long as the photo alterations affect only the personal property (furniture) and not the real estate. The rules require that all photos accurately reflect the property, so no alterations should be made to the physical property. If furniture is added through virtual staging, it is recommended it be disclosed in agent remarks, public remarks or photo captions.” Note ‘recommended’, and note that three locations are all acceptable.
  • WHAT IS MANDATORY is the accuracy limit, not the label. Official policy verbatim: “Photos must not be digitally altered. Altering or ‘photoshopping’ photos to the point they no longer accurately reflect the property is not permitted. While virtual staging is acceptable, the photo alterations can only affect the personal property (e.g., furniture) and not the real estate.” Furniture in; walls, floors, fixtures and landscape out.
  • VIRTUAL PAINTING is expressly addressed and expressly conditional. Verbatim: “Virtual painting is ok if there is full disclosure and you refrain from hiding any defects and do not create a false expectation.” This is the one alteration where NorthstarMLS ties permission to disclosure — paint is treated as an exception to the personal-property-only limit, unlocked by disclosure.
  • TEXT ON PHOTOS IS BANNED OUTRIGHT. Official listing-photo policy verbatim: “No text (regardless of message) is allowed. Instead, use photo captions for messages and photo descriptions.” The parenthetical ‘regardless of message’ forecloses the argument that a compliance label is a permitted exception.
  • PROPOSED 2026 AI GUIDELINES — NOT ADOPTED, DO NOT CITE AS RULE. On July 10, 2026 NorthstarMLS published ‘Guidelines for Virtual Staging and AI-Enhanced Listing Photos’, introduced on its own page as “These proposed guidelines” and written in ‘should’ language. They would require disclosure of any virtually staged / AI-generated / AI-enhanced photo in the caption, on the photo, or in agent or public remarks; would require at least one unaltered ‘Before’ image for every room staged or enhanced; would limit staging to personal property; and would permit only standard corrections (crop, exposure, colour balance, dust retouching). Until adopted, these are best practice. Their status should be re-checked each quarter.
  • INTERNAL TENSION WORTH KNOWING: the proposed guidelines list “On the altered photo” as an acceptable disclosure location, while the standing listing-photo policy bans text on photos ‘regardless of message’. Until NorthstarMLS reconciles the two, caption or remarks is the only location that is safe under both documents.

Does NorthstarMLS require you to disclose virtually staged photos?

No — it recommends it. They are proposed guidelines, not adopted rules — NorthstarMLS says so on the page itself (“These proposed guidelines outline where the line is drawn…”) and writes them in ‘should’ language. Published July 10, 2026, they would have any virtually staged, AI-generated or AI-enhanced photo identified in the caption, on the photo, or in agent or public remarks; would have every staged or enhanced room accompanied by at least one unaltered ‘Before’ image; would limit staging to personal property and prohibit fabricating permanent features; and would permit only standard corrections such as cropping, exposure, colour balance and dust retouching.
